RULES & REGULATION

By providing my registration information to the Organizer through various channels (including, but not limited to, the official website, email, and other registration platforms) for participation in the Ho Chi Minh City Marathon – HCMC Marathon 2027, I agree to comply with all rules and regulations established by the competent authorities, the Organizer, event management entities, and support teams. I further acknowledge and accept the terms and conditions, including this Electronic Waiver and Release of Liability, upon submitting complete and accurate information through the registration form.

REGISTRATION REGULATIONS

1. Eligibility Requirements The Ho Chi Minh City Marathon 2027 ("Race") is open to runners who satisfy all eligibility requirements set forth in these Regulations. 1.1. Runners must meet the minimum age requirement applicable to their registered race distance as of the Race date. Age shall be determined based on the Runner's date of birth as stated on a valid identification document, as follows: - Marathon (42 km): 18 years of age or older; - Half Marathon (21 km): 16 years of age or older; - 10 km: 12 years of age or older. 1.2. Runners are responsible for providing complete, accurate, and truthful registration information as required by the Organizer. 1.3. For participants under 18 years of age, registration must be completed or authorized by a parent or legal guardian in accordance with applicable laws. The Organizer reserves the right to request supporting documents or information to verify eligibility requirements.   2. Registration 2.1. Registration fees shall be applied according to the fee schedule announced by the Organizer from time to time. Each registration entry is valid for one individual and one race distance only. 2.2. All registration fees paid are non-refundable under any circumstances. 2.3. Registration must be completed through the official Race website or other authorized registration channels announced by the Organizer. 2.4. By completing registration, the Runner acknowledges that they have: - Read and understood the Race Regulations in their entirety; - Agreed to comply with all rules, instructions, and official announcements issued by the Organizer; - Agreed to the Privacy Policy; - Agreed to the Electronic Waiver and Release of Liability. 2.5. The Organizer reserves the right to deny participation, invalidate race results, revoke awards, medals, or related benefits in cases where a Runner violates these Regulations or provides false or misleading information.   3. Health Declaration 3.1. The Runner confirms that they have independently assessed their physical condition and will participate in the Race only if they are fit and capable of completing their registered distance. 3.2. The Runner is solely responsible for the accuracy of all health-related and personal information provided to the Organizer. 3.3. The Organizer does not conduct medical evaluations on behalf of the Runner and does not guarantee that any Runner is medically fit to participate in the Race. 3.4. The Runner's health data shall be processed in accordance with the Privacy Policy and applicable personal data protection laws.

BIB NUMBER AND TIMING CHIP

1. Race Kit and Bib Collection 1.1. The Race Kit shall include the items announced by the Organizer for each race distance and each Race edition. 1.2. Runners are responsible for collecting their Race Kit at the designated time, location, and in accordance with the Organizer's instructions. 1.3. When collecting a Race Kit, the Runner or an authorized representative must present the documents, confirmation code, or information required by the Organizer. 1.4. Upon receipt of the Race Kit, the Runner is responsible for verifying all information and issued items. Any request for correction must be submitted to the Organizer within the specified period.   2. Use of Bib Numbers 2.1. Each Runner shall be assigned a Bib Number corresponding to their registration information and may only be used by that Runner. 2.2. The Runner must wear the Bib Number in accordance with the Organizer's requirements throughout the Race. 2.3. Runners are prohibited from: Altering, obscuring, or modifying any information displayed on the Bib Number; Using a Bib Number not issued by the Organizer; Using more than one Bib Number during the same Race; Using another person's Bib Number or allowing another person to use their Bib Number. 2.4. Registration transfers may only be made in accordance with the Race Regulations and applicable policies. 2.5. The Organizer reserves the right to invalidate race results associated with unauthorized or improperly used Bib Numbers.   3. Timing Chip and Race Results Recording 3.1. Each Runner shall be provided with a timing chip or a Bib Number incorporating a timing chip, as determined by the Organizer. Runners are responsible for properly maintaining and using the timing chip throughout the Race. 3.2. Race results shall be determined based on data collected by the Organizer's official timing system. Runners must pass through all designated timing checkpoints along the course. 3.3. The Organizer shall not be responsible for missing timing data resulting from improper use, damage, loss, or other actions attributable to the Runner. 3.4. The Organizer reserves the right to invalidate race results in the following circumstances: Missing data at mandatory timing checkpoints; Failure to follow the official course; Use of an invalid Bib Number or timing chip; Fraudulent conduct or violations of these Regulations. 3.5. Race result status shall be classified as follows: - DNS (Did Not Start): The Runner did not start the Race; - DNF (Did Not Finish): The Runner did not validly complete the Race; - DQ (Disqualified): The Runner was disqualified for violating the Race Regulations. 3.6. The Organizer reserves the right to review, verify, amend, or invalidate race results based on timing data, photographic evidence, video recordings, and other valid supporting evidence.

DISTANCE CHANGE AND REGISTRATION TRANSFER

1. Distance Change 1.1. Runners may request to change their registered race distance within the period announced by the Organizer. A distance change fee of VND 100,000 per Runner per request shall apply. 1.2. Where the new distance carries a higher registration fee, the Runner must pay the applicable fee difference. Where the new distance carries a lower registration fee, any fee difference shall not be refunded. 1.3. The Organizer reserves the right to reject a distance change request if: The request is submitted after the applicable deadline; The requested distance has reached capacity; Registration information is incomplete or invalid; The requested change may adversely affect Race operations or safety. 1.4. Distance upgrade and downgrade policies do not apply to complimentary entries, sponsored entries, or other special registration categories.   2. Registration Transfer 2.1. Runners may transfer their registration entry in accordance with the procedure established by the Organizer. A transfer fee of VND 300,000 per Runner per request shall apply. 2.2. Any sale, exchange, assignment, or transfer of a registration entry outside the Organizer's official transfer process shall not be recognized. 2.3. A transfer shall only become effective after: - All required procedures have been completed; - All applicable fees have been paid in full; The Organizer has confirmed the successful transfer. 2.4. The Organizer reserves the right to reject a transfer request if: The transfer request is submitted after the applicable deadline; The submitted information is incomplete or inaccurate; There are indications of fraud or violations of these Regulations. 2.5. The Organizer shall not be responsible for any disputes, losses, or damages arising between parties in connection with a registration transfer. 2.6. The registration transfer policy does not apply to complimentary entries, sponsored entries, or other special registration categories.

RACE RULES AND COURSE REGULATIONS

1. Start Area 1.1. The Organizer shall assign start areas for each race distance based on the number of participants, course operational capacity, safety requirements, and other organizational considerations. 1.2. Runners may access the start area only through the designated entry points established by the Organizer. Each Runner must start the Race from the start area assigned by the Organizer. 1.3. The start gate will close at the time announced by the Organizer. Runners who fail to start before the start gate closes may be recorded as DNS (Did Not Start).   2. Cut-off Time (COT) 2.1. The official Cut-off Time (COT) for each race distance shall be announced by the Organizer prior to Race Day. 2.2. Cut-off Times are established to: - Ensure the safety of Runners; - Support traffic management and public security plans; - Facilitate the safe and efficient operation of the Race. 2.3. Any Runner who does not complete the Race within the applicable Cut-off Time shall be recorded as DNF (Did Not Finish). 2.4. The Organizer reserves the right to adjust Cut-off Times when necessary to comply with requirements of competent authorities, weather conditions, or other circumstances beyond the Organizer's reasonable control.   3. Compliance Obligations 3.1. Runners are required to comply with these Regulations, all instructions, and all official announcements issued by the Organizer. 3.2. Throughout the Race, Runners must follow the directions and instructions of: The Organizer; Race officials and course marshals; Medical personnel; Security personnel, police authorities, and other relevant government agencies; Volunteers assigned by the Organizer. 3.3. Runners must conduct themselves in a respectful and sportsmanlike manner toward all participants and must not: - Insult, threaten, harass, or abuse others; - Disrupt public order; - Interfere with the Organizer's operations; - Intentionally affect the performance or safety of other Runners. 3.4. The Organizer reserves the right to take appropriate disciplinary action, including disqualification (DQ), against any Runner who fails to comply with the provisions of this Section.   4. Race Rules 4.1. Runners must complete the full registered race distance by following the official course published by the Organizer. 4.2. Runners are prohibited from: - Taking shortcuts or otherwise shortening the official course; - Bypassing mandatory checkpoints; - Using unauthorized assistance or transportation; - Allowing another person to participate in the Race on their behalf; - Using an invalid Bib Number or timing chip; - Receiving assistance that compromises the fairness or integrity of the Race. 4.3. The Organizers may determine rule violations based on: - Timing system data; - Recorded photos or video footage; - Reports from race officials, volunteers, or technical personnel; - Other valid evidence. 4.4. Fraudulent conduct or serious violations may result in: Disqualification (DQ); Voiding of race results; Withdrawal of prizes or related entitlements; Exclusion from future editions of the Race.   5. Race safety 5.1. Participants should only carry items necessary for their participation. Permitted items include: mobile phones; personal audio devices; sports watches; personal water bottles or hydration vests; and other lawful items that do not pose a safety risk to the Race. 5.2. Prohibited items include, but are not limited to: Weapons, explosives, or flammable materials; Narcotics or substances prohibited by law; Unmanned aerial vehicles (drones); Banners, items, or materials containing unlawful content; Any items capable of causing harm to other participants. 5.3. Persons without a valid BIB are not permitted on the race course or in any restricted areas of the Race. 5.4. Unless prior written approval has been granted by the Organizers, participants are not permitted to: bring pets; bring children onto the course; use bicycles, motorbikes, or other wheeled vehicles; or have personal pacers running alongside them on the course. 5.5. The Organizers reserve the right to inspect participants' personal belongings to the extent necessary to maintain security, safety, and legal compliance.   6. Medical decisions 6.1. Medical personnel designated by the Organizers have the authority to assess a Participant's physical condition throughout the Race. 6.2. If there are reasonable grounds to believe that continuing to compete could endanger a participant’s health or life, medical staff have the authority to require the athlete to stop competing. 6.3. The Organizers have the right to carry out or coordinate necessary medical assistance measures in emergency situations. 6.4. Participants must cooperate with medical personnel and provide relevant health information when requested. 6.5. Compliance with a decision made by medical personnel or the Organizers on safety grounds does not constitute a basis for claiming recognition of race results or compensation. 6.6. Should a Participant refuse to follow medical personnel's instructions, the Organizers reserve the right to take necessary measures to ensure safety and may disqualify the Participant. 6.7. All costs arising from medical treatment, emergency transport, or other medical services are the sole responsibility of the Participant, unless otherwise required by law or separately notified by the Organizers.

RESULTS AND AWARDS

1. Official results 1.1. A Participant's official race result is determined based on data from the official timing system operated or designated by the Organizers. 1.2. Race performance is recorded by: Gun Time: The time elapsed from the official start of the race distance until the Participant crosses the finish line; Chip Time: The time elapsed from the moment the Participant crosses the timing mat at the start area until they cross the finish line. 1.3. Unless otherwise announced by the Organizers, competitive rankings are determined by Gun Time; Chip Time is used to record individual performance and for result verification purposes. 1.4. In the cace of a dispute or discrepancy, data from the Organizers' official timing system shall take precedence. The Organizers reserve the right to review, verify, adjust, or void race results as necessary.   2. Awards, medals, and finisher benefits 2.1. The Organizers present awards to participants who achieve outstanding results in accordance with the prize structure published on the race’s website for each year of the Race. 2.2. To be eligible for an award, a Participant must: Have completed the race under valid conditions; Not be in breach of these Regulations; Have completed all verification procedures required by the Organizers. 2.3. The Organizers reserve the right to request that athletes provide the necessary documents or information to verify their eligibility to receive the award. Participants are responsible for providing truthful, complete, and accurate information to complete the award acceptance process. In the Race that issues arise due to inaccurate or incomplete information provided by the participant, the participant shall be solely responsible and shall bear all related costs incurred. 2.4. If a violation is discovered after the results have been announced or the awards have been presented, the Organizers reserve the right to invalidate the results, revoke the awards, medals, or related benefits, and adjust the rankings. 2.5. Participants who validly complete their registered distance will receive a finisher medal. Participants who complete the Marathon (42 km) will additionally receive a Finisher Shirt in accordance with the Organizers' specifications. 2.6. Participants recorded as DNS, DNF, or DQ are not entitled to finisher benefits, unless otherwise determined by the Organizers. 2.7. Any tax obligations or fees arising in connection with prizes, where applicable, shall be handled in accordance with Vietnamese law.

ELECTRONIC WAIVER

1. Voluntary participation and assumption of risk 1.1. By registering for the Race, participants confirm that their participation is entirely voluntary. 1.2. The participant understands that road racing involves many potential hazards. The participant accepts all risks associated with participating in the race, including unforeseeable circumstances, ranging from minor to severe injuries, and including but not limited to slipping, falling, or colliding with others, weather conditions, traffic, track conditions, and even death, as well as other unforeseeable risks that may arise during participation. 1.3. Participants confirm that they have assessed their own ability to participate and voluntarily accept the risks inherent in running. 1.4. By reading and fully understanding the terms and conditions and the risk assumption provisions set forth herein, the participant - or any individual acting on the athlete’s behalf - agrees to release the Organizers, the organizing entity, Ho Chi Minh City, and their respective officers, employees, sponsors, volunteers, general contractors, subcontractors, agents, and other related parties from any claims, demands for compensation, or disputes arising from participation in the Race. This includes cases arising from negligence or carelessness, whether partial or total, on the part of the parties named in the articles of association.   2. Commitment to compliance 2.1. Participants  agree to comply with: The Competition Rules; The regulations, guidelines, and announcements issued by the Organizing Committee; Instructions from medical staff; Regulations issued by the competent government authorities. 2.2. Safety measures taken by the Organizers or medical personnel do not constitute grounds for any claim for compensation against the Organizers. 2.3. In the race that the Organizers, medical personnel, or support staff identify signs that a Participant's health may be at risk or that emergency assistance is required, the Organizers have the right to carry out or direct necessary medical assistance, including on-site first aid or transfer to an appropriate medical facility. Participants agree that such medical decisions are made in the interest of their safety and do not give rise to any liability on the part of the Organizers. 2.4. Participants bear sole responsibility for all costs arising from medical consultation, treatment, medical transport, hospitalization, and related expenses incurred in connection with their health care or treatment during the race. 2.5. The Organizers do not guarantee coverage of accident insurance, medical insurance, or any form of financial assistance for participants, unless officially announced by the Organizers prior to the race.   3. Final confirmation 3.1. By completing registration for the race, Participants confirm that they have: Read and understood the race regulations in full; Been given the opportunity to review all regulations governing participation in the race; A clear understanding of their rights and obligations; Agreed to comply with the Race Regulations and all rules issued by the Organizers; Agreed to the Race's Privacy Policy; Agreed to the terms of this Electronic Waiver. 3.2. Completion of registration by electronic means constitutes valid acceptance by the Participant of the Race Regulations, Privacy Policy, and Electronic Waiver in their entirety. 3.3. If the registration is completed on behalf of a minor or a person who lacks full legal capacity under applicable law, the person submitting the registration confirms that they hold full legal authority to accept the above terms on behalf of the participant.

PRIVACY POLICY

1. Collection and processing of personal data 1.1. By registering for or participating in the Race, participants consent to providing the Organizers with information necessary for the organization, operation, and administration of the Race. 1.2. Data collected may include personal information, health information provided by the Participant, timing data, race results, photos, video, data generated through the website or registration system, and other information voluntarily provided by the Participant. 1.3. The Organizers collect and process data only to the extent necessary and in accordance with the purposes set out in this Policy and applicable law.   2. Purposes of data use 2.1. The Organizers use participants' personal data to: Receive and manage Race registrations; Verify registration information and eligibility; Manage race kits, BIBs, the timing system, and race results; Organize, operate, and maintain the safety of the Race; Communicate with, support, and address Participant inquiries; Distribute prizes and related entitlements; Conduct media and promotional activities for the Race; Fulfill obligations under applicable law.   3. Data sharing and protection 3.1. The Organizers may share personal data with service providers involved in organizing the Race, including but not limited to timing, medical, information technology, and insurance (if applicable) service providers, as well as competent government agencies in accordance with the law. 3.2. The Organizers require all relevant parties to apply appropriate security measures and to use data only for permitted purposes. 3.3. The Organizers do not sell participants' personal data to third parties.   4. Data retention 4.1. Personal data is retained for as long as necessary for the organization of the Race, maintenance of historical performance records, resolution of disputes, fulfillment of legal obligations, and other lawful purposes. 4.2. When the data is no longer necessary or as required by law, the Organizers will delete, destroy, or anonymize the data in accordance with current regulations.

Your information, whether personal or general, will not be sold, exchanged, transferred, or made available to any other company for any reason without our consent, except for the purpose of providing the products or services you have requested. To manage contests, promotions, surveys, and other website features. To send periodic emails. The email addresses you provide may be used to send you information and updates related to your registration, as well as company news, updates, and information about related products or services, etc. Note: If at any time you wish to unsubscribe from future emails, we provide details at the bottom of each email so you can click the “Unsubscribe” button.   3. How do we protect your information? We implement various security measures to ensure the safety of your personal information when you enter, submit, or access it. We provide a secure server. All sensitive information and credit card information provided will be transmitted using Secure Socket Layer (SSL) technology and then encrypted in our providers’ databases. Our payment gateway can only be accessed by authorized personnel who have special access to the system and are strictly required to keep the information confidential. After the transaction, your personal information (credit card details, Social Security number, financial information, etc.) will not be stored on our servers.   4. Do we disclose information to third parties? We do not sell, trade, or transfer your personal information to outside parties. This does not apply to trusted third parties who assist us in operating our website or conducting our business, or who serve you directly, provided those parties agree to keep your information confidential. The Organizers accept no responsibility for the content, practices, or data handling of any linked third-party websites. The Organizers nonetheless strive to maintain the safety, transparency, and integrity of their website and welcome feedback regarding any linked third-party sites.   6. Your Consent By using our website, you are deemed to have read, understood, and agreed to the terms of this Privacy Policy.   7.
